Britton G. Swank, Esq. | Attorney

Britton earned her Juris Doctorate with High Honors from the University of Florida Levin College of Law in December 2002 and was admitted to the Florida Bar in 2003. Since then, she has dedicated her legal career exclusively to elder law, focusing on estate planning, guardianship, Medicaid and VA benefits, and probate and trust administration.

Deeply committed to advancing elder rights and advocacy, Britton previously served as co-chair of the Elder Law Section and Academy of Florida Elder Law Attorneys Joint Public Policy Task Force, which engages directly with legislators, the judiciary, and state agencies to shape policy and support elder care initiatives.

Outside her legal practice, Britton is actively involved with The Dubin Center, a Fort Myers nonprofit supporting individuals affected by memory impairment and their caregivers. She has served on its Board of Trustees since 2004 and is a former board president.

Tricia Winterstein, Certified Paralegal/Florida Registered Paralegal

Tricia began working for an elder law attorney in 1990 while completing her paralegal degree, and obtained her national certification as a Certified Paralegal in 1994. She graduated from the University of South Florida with a Bachelor of Arts degree in Business Administration in 1995. After completing her educational and professional goals, Tricia married her husband Jeff in April 1996, and eight years later, the couple welcomed their son Alex.

Since 1990, Tricia has primarily focused on assisting families with navigating the confusing and overwhelming Medicaid eligibility and application process. Tricia strives to provide support and compassion to clients and families who are often in times of crisis. She understands that preparing for long-term care for a loved one is a difficult and emotional process. Tricia also assists the families of loved ones with special needs to preserve their rights through Guardian Advocacy proceedings.

Away from work, Tricia enjoys spending time with her family, gardening, cooking, and attending her son’s chorus performances in Orlando. She also keeps an active pace by running 5Ks and spoiling her rescue dog, Rosie.

Peggy Polsinelli, Florida Registered Paralegal

Born in upstate New York and raised in western Massachusetts, Peggy made Southwest Florida her home in 1988. She launched her legal career shortly thereafter, when she began working for an elder law attorney. In 1992, Peggy earned her paralegal degree and passed the national certification exam to become a Certified Paralegal, and is designated as a Florida Registered Paralegal by The Florida Bar.

With more than 30 years of experience in elder law, Peggy focuses on estate planning and administration. She plays a vital role in guiding clients and their families through the estate planning and administration process with knowledge and care, ensuring clarity and efficiency at every stage. Her strong organizational skills and deep understanding of elder law make her a reliable resource for both clients and their families.

In her free time, Peggy enjoys spending time with her family, as well as cooking, reading, and indulging in a bit of shopping.

Kelly Scagliotti, Florida Registered Paralegal

Born in Fayetteville, North Carolina, Kelly moved to Fort Myers when she was just three months old, and has called Florida home ever since. As a third-generation Floridian, her roots run deep: her father was born in LaBelle, her mother in Fort Myers. Kelly holds a BS in Education, a minor in Interdisciplinary Studies, and an AA in Paralegal Studies.

Today, she brings both personal and professional insight to her role as a Florida Registered Paralegal, assisting with Probate, Guardianship, and Trust Administration matters. Having walked these paths with her own family, Kelly understands the emotional weight that often comes with them and meets each client with empathy and knowledge.

Outside of work, she’s a proud mother to two grown daughters and a grandmother to three spirited grandsons. When she’s not playing with the grandsons, she’s often reading, gardening, or lovingly negotiating with her rescue dog, who still believes he runs the show.

Judy Allen | Office Administration

A native of West Palm Beach, Judy’s life has taken her far from her Florida roots—from the snowy landscapes of Northern Michigan to the island beauty of Guam—as she built her family in a military setting. Eventually, she returned to her home state, making her way to LaBelle and now calling Lehigh Acres home.

With three decades of administrative experience in the agricultural industry, she now keeps things running smoothly as the firm’s Office Administrator.

Outside the office, she’s a devoted grandmother to ten, a rescue dog mom to Brody, and an enthusiastic fan of Hallmark movies. Judy finds joy in discovering the benefits of gardening, essential oils, and herbal healing.

Candi Girtman | Reception

Candi grew up in Southwest Florida and is a 1992 graduate of the University of South Florida, where she earned her Bachelor of Science in Gerontology. She began her career serving seniors as a case manager with Hillsborough County Aging Services. After stepping away from the workforce to start a family with her husband, Grant, she spent over a decade serving her church community, working with preschoolers and their families. In 2018, Candi returned to her gerontology roots as the welcoming face of the firm’s front desk. In her free time, she loves cooking, staying active through life’s everyday adventures, and spending quality time with her family and friends.

“It is with great confidence that I can personally recommend Britton Swank for your estate planning needs. Her personal commitment to my family in securing my quality of life while living and the transfer of my estate to my son upon my passing has been very comforting to everyone concerned. I would highly recommend her to others as you plan for today, tomorrow, and your legacy.”

Pam A.

Fort Myers, FL

“Once I met with Britton Swank, a huge burden was lifted. She and her assistant not only walked me through the process, they were always available. I knew I was never alone and that gave me great comfort. Ms. Swank even met me at the bank on a Saturday morning when the branch manager was refusing me access to the safety deposit box even though I had all the court orders giving me full access.”
